Immigration Attorney Misconduct | Be Careful Who You Hire

The Executive Office for Immigration Review released a decision last week that suspended a New York attorney from practicing law in front of the Board of Immigration Appeals (BIA), the Immigration Courts and the Department of Homeland Security for six months. According to the decision, this suspension arose because the attorney made a habit of not showing up for hearings for his clients. He also made frivolous filings and false assertions in his client's cases.

This was not the attorney's first brush with professional sanctions. In fact, he has been warned a number of times and was recently suspended by the Second Circuit for three months for missing filing deadlines for briefs in multiple cases. According to the opinion, the attorney's antics directly caused him to lose 125 of 190 cases between 2005 and 2008.
