Federal Judge Stops DACA

It's Jim Hacking reporting live from Lake Minnetonka, Minnesota. I am on vacation for today and I have been out of the office for a few days. I wanted to shoot this quick video to talk about the recent decision from that federal court down in Texas, striking down the deferred action for childhood arrivals program DACA. This judge has prohibited the Department of Homeland Security from issuing any more approval notices for pending DACA applications. Those who are in the United States with deferred action for childhood arrivals, do not have to leave the United States. Their deportations will not immediately recommence but they are now going to be prohibited from having any future applications approved. And the Department of Justice is appealing the decision, but it's obviously very troubling of course. You might be scratching your head, wondering to yourself, why is this happening when the Supreme Court has already upheld the DACA program?

And that's a legitimate question. We have some activist judges down in Texas who hate president Obama and hate president Biden. And this fellow who has ruled against the deferred action for childhood arrivals program has a history of ruling against the Obama team and their administrative initiatives when it comes to immigration. The one thing that I want to emphasize more than anything is that this is just a God damn sign that Congress needs to act. And I'm sick of hearing from Joe Biden and Alejandro Mayorkas that oh, well, we don't really have a big majority in the Senate and oh, we can't really get anything passed. It's time to bust the filibuster. The filibuster needs to go and Congress needs to pass the dream act either through the reconciliation process or by issuing an override of the filibuster and just going on a straight majority vote.

I know we have people like Joe Manchin and that Sinema from Arizona who aren't willing to do that, but this has just got to get done. This is no way to let these kids live their lives in limbo. It's really outrageous that this is the best that we can get when it comes to immigration reform and I've just had it. So Joe Biden and Mayorkas, they can twiddle their thumbs and look all sad on television. But until they do something affirmative and actively to get immigration reform passed, we're just going to be spinning our wheels. And we're going to have these immigrant kids worried about their status and their situation. It's really upsetting. It's really ridiculous. And it's just another example of the right wing GOP tying up what the vast majority of Americans want as that is immigration status for these young people who came to the United States through no fault of their own. Hopefully we'll start to see some action, but I'm not hopeful.

In the short term, you should know that you can stay in the United States if you're a DACA person. You don't have to leave. It's just that at the moment, while this case is working its way through the courts, apparently the Department of Homeland Security and USCIS will not be able to approve any more DACA applications, which is of course, why we always tell people to take advantage of an immigration benefit as soon as you can, because you never know what's going to happen.
