USCIS, the United States Citizenship and Immigration Services, is tasked with overseeing lawful immigration and dealing with requests for immigration benefits. When an immigrant files an application for a visa, they do so through USCIS. Before the Trump Administration, is was very simple to apply for an immigrant visa through USCIS.

However, under the Trump Administration, USCIS has tightened. Many applications have gotten longer and more in-depth, and at the same time there has been a significant increase in the amount of denials and RFE’s (Request For Evidence) being given. They are looking for any reason to deny an applicant, whereas before the Trump Administration they were much more relaxed.
USCIS wants to deny cases. They do not want to accept any immigrant that they do not have to accept, and they are trying to lower the immigration rate. They are doing this because of the Trump Administration, and President Trump’s promise when he was campaigning to lower immigration, legal and not legal, into the U.S.
USCIS is also very backlogged with cases. Before the Trump Administration, employment-based cases, for the most part, did not require an interview. In 2017, the Trump Administration ordered that every applicant applying for a green card must be interviewed. Therefore, employment-based cases took longer to approve. USCIS has much more work than they used to, and they are very behind. This is also why wait times have increased.
Because USCIS is now interviewing everyone who is applying for an employment-based case such as an H-1B, they are going to try to find anything they can to deny the applicant. They are going to doubt that an immigrant is necessary for the position, as opposed to an American that already lives in the U.S. This is because of an executive order from President Trump, the Buy American and Hire American Executive Order.
