Don't leave and come right back on a visit visa. Hi, I'm Jim Hacking, immigration lawyer practicing law throughout the United States of our offices in St. Louis, San Diego, and Washington DC. The big issue with visit visas is sometimes people abuse them. We've received a lot of contacts this week from different people who got in trouble on their visit visas. One guy was coming back and forth from Mexico and based on what he told me, it sounded like he was doing a little bit of work in the United States on a visit visa. That, of course, is a big no no.

We also got contacted by a fellow who came to the United States. He is from India. He came to United States to visit his girlfriend and he stayed for a couple months, and they decided to take a short weekend trip to Mexico. Well, here's the thing. When he left the United States with his US citizen girlfriend, she was leaving as a US citizen. He was leaving as a non US citizen, as a visitor. And he left on a Friday and tried to come back on a Tuesday, and they said, nah, nah, nah. You're not coming in. And in fact, we're going to revoke your visa because we see you here traveling with your girlfriend. We believe you're coming here to get a green card, even though he wasn't, even though he had every plan to go back to India.

But he left the United States as if he were a US citizen and that's the problem. He left the United States thinking, oh, they'll just let me back in. I have this multiple entry visit visa. No dude, no. That was not going to happen. He was all mad. He wanted to file a complaint with customs and border patrol. Actually they both did, both of those guys did. And I was like, no, they didn't do anything wrong. You were acting like you lived here in the United States. And that's the biggest problem of all, because a visit visa is a non immigrant visa and he was acting like he had an immigrant visa. He was acting like he was a green card holder or a US citizen.

So, if you come to the United States on a visit visa and somebody says, hey, let's go over to Barbados or let's go to Bermuda or Mexico, don't do it. When you're in, you're in. When you're out, you're out. You don't get to come back and forth like US citizens and green card holders. So that's why this poor guy got in trouble. He got his visa revoked. I think it's unlikely he's going to get another one. So, don't make that mistake. Don't come to the United States on a visit visa and then leave right away and try to come back right away. That's the problem.
