Work Card Delay Lawsuit

Hey everybody it's Jim Hacking. It's Tuesday, September 8th, 2020. I am home on quarantine and I won't be going to the office to make videos for a while. So I'm just going to be making one daily video in my backyard. Today's video is about employment authorization documents. USCIS stopped producing these documents back in April and there's a huge backlog. It's probably around 75,000 people have received approval notices of their I-765, but have not yet received their actual work authorization cards.

Some really good lawyers at a firm called Porter Wright filed a lawsuit recently against USCIS and they also asked for a temporary restraining order asking a federal judge to compel USCIS to issue these long delayed work authorization cards. The judge held the hearing, took testimony and the judge has ordered USCIS to produce these work authorization cards. So if you have an approval notice and you have not yet received your EAD, your employment authorization document, you might be able to go to work with the approval notice itself.

While the lawyers and the judge were trying to figure out how exactly to best implement the order because USCIS couldn't approve and create 75,000 work authorizations overnight. They entered into a consent decree whereby proof of the approval notice itself would be proof for column C on completing an I-9 form when someone had authorization to work.
