I Did an intake interview back in December for a very sentive Vawa case(violence against woman act) with JUAN. I have Never heard back from this law firm.
Thankfully I found another law firm willing to help me.
But don’t let a men do this type of interview it’s very uncomfortable and then not even reach out!
Just leave on waiting for a response?!
It’s was an awful thing to do.
Especially to someone that’s already going through so much!
Again don’t let a men do the intake interview with woman’s that have been abused by men already, have also some empathy and respect!
That interview was SO UNCOMFORTABLE!
His whole tone made me feel I was to blame for what has happened!

I entered the United States in year 2023 with a B1/B2 visa I have been traveling to United States since 2001 I never over stayed my visa I have travelled to over 100 countries all over the Globe this time also I had no intention to stay back here then I met my wife at the place I was working and we eventually fall in love and decided to get married I filed my I 130,I 485 and I 765 I got my EAD approved within couple of months after filing and unfortunately I received RFE for I 864 and medical and my birth certificate my previous attorney responded and I got my I 485 denied I was really not in a good situation it all happened because my previous attorney made a mistake in responding to my RFE to USCIS and then I came in contact with Hacking Immigration Law where I was exchanging emails with Mr. Jim hacking and his team and eventually we decided to refile my I 485 and I 765 with a team of Jim hacking,attorney Christina who is in their San Diego office and Miss Tamara I should mention the whole Miss Yani Mercedes in accounts department Miss Lady at reception all of them were extremely helpful anyways let’s cut this short we re applied and received a letter for interview and everything was so precise and smooth Mr. Jim hacking was with us for the interview and I was approved for 10 years green card I can’t thank enough to attorney Christina who guided everything Miss Tamara and last but not the least Jim guys if you have any situation provided your case is genuine look no where else find Hacking Immigration they are the best.

Wish I could leave more then 5 stars! me and my fiancé
are doing the k1 visa and the process is only around
half done so far but this team has been fantastic!! they have been kind,
helpful and super out going! they make you feel much more calm about

They did our marriage based green card. We filed 12/26/24, and got the green card 7/22/25. They did a great job, it was handled seamlessly and quick. I plan to hire them again. They don't make any bilingual accomodations for Spanish speaking clients, one thing that i thought was kinda missing. They also aren't the most jovial, but they know their business and they want to get every case approved. Highly recommend.

We hired them early 2024 for a Marriage based GC. By the end of March the same year everything was filed. Less than a year later we got our GC and even got work permit and advanced parole only 3 months after filing. The team know what they are doing ! Tom was our attorney and we couldn't be more pleased. They have payment options too and a FB page called "Immigrants home" where Jim shares a lot of his knowledge for free. Don't forget to also check his YouTube channel where he answers questions multiple times a week for free !

They did our marriage based green card. We filed 12/26/24, and got the green card 7/22/25. They did a great job, it was handled seamlessly and quick. I plan to hire them again. They don't make any bilingual accomodations for Spanish speaking clients, one thing that i thought was kinda missing. They also aren't the most jovial, but they know their business and they want to get every case approved. Highly recommend.

We hired them early 2024 for a Marriage based GC. By the end of March the same year everything was filed. Less than a year later we got our GC and even got work permit and advanced parole only 3 months after filing. The team know what they are doing ! Tom was our attorney and we couldn't be more pleased. The 5 Employment-Based Preference Categories


Foreign nationals can get employment-based immigrant visas if they qualify under one of the five preference categories under the U.S. immigration law:

1. EB-1: First Preference - Priority Workers

This is reserved for top performers in their fields. It doesn’t require labor certification. Processing is often faster than other categories, though visa backlogs may apply depending on the country of chargeability.

These are the three types:

  • EB-1A (Extraordinary Ability): This is for foreigners who possess extraordinary ability in athletics, business, science, education, and the arts. Applicants must meet three out of 10 USCIS criteria, such as high salary, publications, critical roles, and awards. EB-1A allows self-petition with no employer sponsorship needed.
  • EB-1B (Outstanding Professors and Researchers): This is for individuals with at least three years of experience and international recognition as outstanding in their academic field. They must have a job offer for a tenured or comparable research position at a university.
  • EB-1C (Multinational Executives and Managers): This is for multinational executives and managers transferring to an American affiliate, parent company, or subsidiary. They must have worked abroad in a managerial or executive capacity for at least a year within the last three years.

2. EB-2: Second Preference - Advanced Degree Professionals and Exceptional Ability

This category serves professionals with advanced degrees and people with exceptional ability. It generally requires labor certification unless one qualifies for a National Interest Waiver (NIW).

These are the types of EB-2:

  • EB-2 (Advanced Degree or Exceptional Ability): For professionals with an advanced degree - master’s or higher, or a bachelor’s degree and five years of experience - and those who show exceptional ability in business, sciences, and arts.
  • EB-2 (National Interest Waiver or NIW): For individuals whose proposed endeavor contains substantial merit and is of national importance. As determined by the standards established in Matter of Dhanasar, the applicants must show they’re well-positioned to advance the said endeavor and that refusing the labor certification requirements and the job offer will greatly benefit the U.S. Qualified applicants, such as physicians, researchers, and entrepreneurs, can self-petition without employer sponsorship.

3. EB-3: Third Preference - Skilled Workers, Professionals, and Other Workers

This is the broadest employment-based category. Labor certification is a must for all three groups of EB-3 applicants:

  • Skilled Workers: Foreign nationals performing jobs that require at least two years of training or work experience.
  • Professionals: They hold a bachelor’s or a baccalaureate degree for a role that requires the same level of education.
  • Other Workers: Unskilled workers performing jobs that need less than two years of training. This subcategory may face longer waiting times due to high demand and limited visa availability.

Applicants must provide proof of qualifications if they’re a skilled worker or their degree if they’re a professional.

4. EB-4: Fourth Preference - Special Immigrants

This category is for special immigrants who don’t fit the standard employment-based structure. They typically include:​

  • Religious Workers: These include members of a religious denomination that perform both ministerial and non-ministerial religious vocations.
  • Special Immigrant Juveniles: These are minors in the U.S. who have been abandoned, abused, or neglected and have been placed under juvenile court jurisdiction.
  • Broadcasters, certain physicians, Panama Canal employees, and other classifications under immigration law.

If you’re applying for an EB-4 visa, you need to show your proof of organization affiliation, religious worker documentation, and sponsoring entity documents.

5. EB-5: Fifth Preference - Immigrant Investors

This is for investors who generate jobs in the U.S. through a commercial enterprise investment. It has two paths:

  • Standard EB-5: This requires a minimum investment of $1,050,000 in a new commercial enterprise that creates at least 10 full-time jobs for U.S. workers.
  • Targeted Employment Area EB-5: This needs a reduced investment of $800,000 in a rural or high-unemployment area. It’s a popular path for investors seeking to become permanent residents through a reduced investment threshold.

Show proof of job creation and investment, a business plan, and your source of funds when applying for this visa.

Core Documents Required for Almost All EB Categories

Here’s what you need to show, whether you’re applying for an EB-1 or an EB-5 visa:

1. Personal identification

  • Valid passport
  • Government-issued IDs
  • Birth certificate (with certified translation if it’s not in English)

2. Immigration forms

File these with the United States Citizenship and Immigration Services (USCIS):

  • Form I-140 (Immigrant Petition for Alien Worker)
  • Form I-485 (Adjustment of Status) or DS-260 (Consular Processing)

3. Photos

  • Passport-style photos as specified by the USCIS.

4. Civil Documents

Bring these if applicable:

  • Marriage certificate

Complex Employment-Based Green Card Scenarios

Many employment-based cases don’t move smoothly through the application process. You need specialized legal services from an employment-based immigration attorney for the following situations:

1. Your case involves NIW.

This waiver lets certain professionals with an advanced degree or extraordinary ability to self-petition. It bypasses the labor certification requirement altogether.

To qualify for NIW, you must show that your work is of national importance, has sustained national benefit, and has substantial intrinsic merit.

2. Your employer is a multinational corporation.

Multinational manager or executive candidates must show that they’ll serve in an executive or managerial capacity. This role meets strict legal definitions.

3. You’re changing employers mid-process.

Portability rules allow some foreign nationals to change jobs after 180 days without restarting, but with one condition. The new job has to be in the same or a similar specialty occupation.

4. Your application was denied, or you received an RFE.

Visa denials and RFEs are often due to insufficient evidence of your extraordinary ability, labor certification gaps, or failure to meet the eligibility criteria.

What are the employment-based preference categories?

The five preference categories are:

What’s a National Interest Waiver?

This waiver allows qualified foreign nationals to self-petition for EB-2 classification without a labor certification or employer sponsorship. In the matter of Dhanasar, the applicant should have proposed an endeavor that has substantial intrinsic merit, is of national importance, and is well-positioned to advance it. They should also show that waiving the job offer and the labor certification requirements will benefit the country.

Do I need a labor certification for my green card?

Most EB-2 and EB-3 petitions need a labor certification to prove that no qualified workers in the U.S. can fill certain jobs. NIW petitioners, priority workers, and certain special immigrants don’t need it.

What does "extraordinary ability" mean in immigration?

Under EB-1A, extraordinary ability should show evidence of international acclaim, such as high compensation, publications, and awards, to prove you’re highly competent in your field.

Can I change jobs while my employment-based green card is pending?

You possibly can. AC-21 portability lets you change employers after the I-485 has been pending for 180 days and the I-140 is approved or approvable.
